  • Sec. 10-56. - Days sale permitted. No person who is otherwise licensed shall sell any class C common fireworks in the city on any days other than the following:(1)Independence Day (July 4) and the period of ten calendar days prior thereto, provided that when July 4 falls on a Friday or Saturday, sales shall be permitted through the Sunday next following; (2) Christmas Day (December 25) through New Year's Day (January 1) and the period of ten calendar days prior to Christmas Day, provided that when January 1 falls on Friday or Saturday, sales shall be permitted through the Sunday next following.
  • Sec. 10-57. - Permitted discharges. No person shall ignite or explode any class C common fireworks in the city at any time except the following: (a) During the period from July 1 through July 5. (b) During the period from December 20 through the next following January 3, both dates inclusive. On permitted days the igniting or exploding of such fireworks shall only be between the hours of 8:00 a.m. to 10:00 p.m., except for December 31, when the permitted hours shall be from 8:00 a.m. to 1:00 a.m. on January 1.
  • Sec. 10-58. - Permission to discharge fireworks on another property. No person shall be permitted to discharge fireworks on another's property, either public or private, without the prior written permission of the property owner.
  • Sec. 10-59. - Clean up debris on another property. Any person discharging fireworks on another's property shall clean up any debris within 24 hours from the discharge thereof.

The explosion of firecrackers, skyrockets, roman candles, pinwheels or any other form of fireworks, except the display of fireworks in public parks or other open places within the City under a permit issued by the fire marshal pursuant to the fire prevention code of the City or as provided in Ordinance No. 1994-09.

  • Sec. 11-4. - Fireworks—Sale. It shall be unlawful for any person to sell fireworks within the corporate limits of the City of Fairhope. Code 1962, § 9-5; Ord. No. 708, § I, 12-13-82)
  • Sec. 11-5. - Same—Discharging in public places, permit required. It shall be unlawful for any person to discharge fireworks on the streets, highways, parks or other public places of the city without a permit from the mayor.

  • Sec. 8-4. - Same—Prohibited. It shall be unlawful for any person within this city, or the police jurisdiction thereof, to sell, offer for sale, keep, or have in possession, barter, exchange or give away, furnish at a public place or elsewhere, or otherwise dispose of, use, or explode any fireworks or pyrotechnics described in section 8-3, or to accept the delivery of, receive, have in possession, or possess any of these fireworks or pyrotechnics in any quantity whatsoever. Such fireworks or pyrotechnics are declared to be contraband, and to constitute a nuisance that can be abated only by their confiscation and destruction. Such contraband may be seized, condemned and destroyed in the same way as contraband liquors and beverages.
  • Sec. 8-5. - Same—Exemption. Section 8-4 shall not apply to the possession, sale, disposal or use of sparklers and dipped sticks, when the total pyrotechnic composition does not exceed one hundred (100) grains each in weight and when the pyrotechnic composition, containing any chlorate and perchlorate, does not exceed five (5) grains.
  • Sec. 8-6. - Same—Displays may be authorized. Nothing herein shall prevent the city council from approving possession and explosion of fireworks for a public display under such rules and regulations as may from time to time be established.

  • Sec. 8-2. - Fireworks—Definition. When used in sections 8-3 and 8-4, the term "pyrotechnics" shall mean and include one or more of the following: Any sparklers, squibs, rockets, firecrackers, Roman candles, fire balloons, signal lights, torpedoes, torpedo caps, railroad track torpedoes, flashlight compositions, fireworks of all kinds, or other devices or compositions which are used to obtain visible or audible pyrotechnic displays.
  • Sec. 8-3. - Same—Possession, etc. prohibited, exceptions. It shall be unlawful for any person to have in possession, keep, store, use, manufacture, sell, offer for sale, give away or handle any pyrotechnics within the corporate limits of the city, or within its police jurisdiction; provided, however, nothing in this section shall be held to apply to articles manufactured for use as signal devices, and used as such in the operation of railroads, boats or airplanes, or for other required purposes; and provided further, nothing in this section shall be held to apply to a normal supply of flashlight compositions in the hands of photographers or dealers in photographic supplies.
  • Sec. 8-4. - Same—Displays. The mayor may, upon due application, issue a permit to a properly qualified person to stage a display of pyrotechnics in an open place in the city, or its police jurisdiction. Each such permit shall impose such restrictions as in the opinion of the mayor may be necessary to properly safeguard life and property in each case. A refusal or failure of the person to comply with any such restrictions shall constitute an offense against the city.

  • The explosion of firecrackers, roman candles, pinwheels or any other form of fireworks shall be prohibited, except as set forth herein. Notwithstanding the foregoing, fireworks shall be allowed on the following dates and times: (a) on July 4, from 10:00 AM to 10:00 PM.; (b) on December 31, from 10:00 a.m. to 1:00 a.m. on January 1; and (c) on January 1, from 10:00 a.m. to 10:00 p.m. In addition, the Mayor is hereby authorized to issue a permit, in his discretion, for the display of fireworks in public parks or other open places within the City, subject to such terms and conditions as deemed necessary by the mayor.
